Judge limits actress' damages in 'Housewives' case (AP)

LOS ANGELES ? A judge urged attorneys to try to settle Nicollette Sheridan's wrongful termination lawsuit over her ouster from "Desperate Housewives" on Monday after limiting damages the actress may recoup if she wins at trial.

Los Angeles Superior Court Judge Elizabeth Allen White ruled that Sheridan can seek damages for only one year's pay on the show, not for the entire length of the series. The show is entering its eighth and final season.

Sheridan's character, Edie Britt, was killed off in the fifth season. Attorneys for the show claim it was a creative decision, but the actress says she was wrongfully fired for complaining that "Housewives" creator and executive producer Marc Cherry struck her during a fight in September 2008.

White has pared down the case since Sheridan sued ABC, the network that airs "Housewives," and Cherry in 2010. The judge previously threw out Sheridan's harassment claims against Cherry, and ruled Monday that the actress cannot make reference to his alleged rude behavior toward others.

Her attorney, Patrick Maloney, argued jurors should be allowed to consider whether Sheridan was entitled to wages for at least two seasons since she had options to return to the show for those years. White said the show's producers had discretion to eliminate Sheridan's character and there was no case law that would entitle the actress to seek payment beyond the sixth season.

If Sheridan wins, she may be entitled to punitive damages. But her actual damages would be limited to the roughly $980,000 she would have earned during Season 6 had she not been written off the show.

A jury will consider only Sheridan's battery and wrongful termination claims at trial.

"You're going to spend a lot of money on this case," White told attorneys, who have previously said they would not settle the case.

A trial is scheduled to begin in October.

"Desperate Housewives," a glossy primetime soap opera with an ensemble cast including Terri Hatcher and Eva Longoria, made a pop-culture and ratings splash when it premiered in 2004 but has seen its audience dwindle.

Storm shelter for pets at college is full; shelters for people are not ...

The local shelter for humans at Riverhead High Shelter had had about 120 people in it Saturday evening planning to ride out Hurricane Irene, most sent from Patchogue where there was no more room.

Meanwhile a shelter set up for pets at Suffolk Community College in Northampton was full.

The Suffolk County SPCA? set up two pet-friendly shelters in Suffolk County, one at the Eastern Campus of Suffolk Community College in Northampton and the other at the Brentwood Recreation Center, according to Chief Roy Gross of the SPCA. They are for people who decided to leave their homes during the storm but couldn?t bring their pets with them.

?At last count, the Brentwood site had only about eight animals, and they?ve got all the support services over there,? he said. ?We got the majority of it here.?

He said there was no more room for any more pets at the Suffolk Community College site, and anyone seeking to shelter a pet should go to the Brentwood Recreation Center on 99 Third Avenue, Brentwood.

The Northampton site had about 40 pets sheltered there as of Saturday afternoon. Most were dogs and cats, but there also awerere a few birds and hamsters. They were all in cages.

The people sheltering their dogs at the Woodlands Building in SCC can take shelter at the Peconic Building on the same campus, Chief Gross said.

?We take a picture of them with their animal and get identification and they have to wear an arm band with their name and number on it. We want to make sure we know who?s responsible for each animal if somebody comes in to walk it or something,? he said.

The Eastern Campus also has the SPCA?s Mobile Animal Spay-neuter Hospital (MASH) parked outside the Woodlands buiding during the storm.

The pet-friendly shelters are staffed by the SPCA. ?We?re here 24-7 for the duration of the storm,? Chief Gross said.

There are shelters for humans being run by the American Red Cross at Riverhead High School, Hampton Bays High School and several schools in Southold Town but those shelters do not accept pets.

Both Riverhead and Southampton Town have issued mandatory evacuation notices to residents in mobile homes and people living in low-lying areas near the water, although officials in both towns say they are not forcing anyone to evacuate.

Upton hits 3-run homer as Rays beat Blue Jays 6-5

TORONTO - Few people were certain whether B.J. Upton's sixth-inning drive landed fair or foul. Not even Upton himself knew for sure.

The next time up, he left little doubt.

After barely missing a home run earlier, Upton hit a three-run shot in the seventh that broke open the game and sent the Tampa Bay Rays past the Toronto Blue Jays 6-5 on Saturday.

"He's got as much power as anybody, especially for being so skinny," Rays catcher Kelly Shoppach kidded. "When he gets into a ball, it can be very impressive."

Upton's 18th homer put the Rays ahead 6-2, and Tampa Bay held on despite a pair of late home runs by Toronto.

In Upton's previous at-bat, he led off with a long fly to left field that landed just a few feet foul. Upton and Rays manager Joe Maddon questioned the call with home plate umpire and crew chief Tim Tschida.

"(Tschida) said, 'I'll talk to the boys,' and I guess none of them were absolutely certain, so they did the right thing," Maddon said.

Upton wasn't positive where his drive ended up, either.

"It looked fair from where I was, although it hooked very hard late," he said. "I don't think it hurt to check it out."

After huddling near the mound, three umpires left the field to review the video. They returned two minutes later and confirmed the original call, leaving the score at 2-all.

Upton reached the painful way when Shawn Camp's next pitch hit him on the leg. Sean Rodriguez singled and Kelly Shoppach tried to bunt the runners along.

But Camp (1-3) fielded the ball and threw to Brett Lawrie for a forceout, and the third baseman's throw across the diamond completed a double play. The Blue Jays almost turned a triple play, too, but Rodriguez slid into third just ahead of the return throw. Elliot Johnson followed with a go-ahead single.

Upton connected the next inning against Jesse Litsch. The shot into the second deck in left field scored Sam Fuld and Evan Longoria after they both walked.

"In that situation I'm not trying to do too much, just take what he gives me," Upton said. "He left something out over the plate for me and I got extended on it."

Maddon was pleased with Upton's powerful shot.

"I congratulated him on keeping that ball fair," he said.

The Rays are an AL-best 19-9 since July 28, and haven't given up hopes of winning the wild card. The Rays are seven games behind the second-place Yankees in the AL East.

"I keep saying that we're very much in this race right now," Upton said. "We've just got to continue to try and win series. That's all we can ask ourselves. Hopefully (New York and Boston) hit a little rut and we can gain some ground on them."

Litsch, a converted starter who was working for the third time in four days, denied feeling the effects of fatigue.

"I left the one ball up that Upton hit," Litsch said.

Rodriguez and Johnson each had three hits for the Rays.

Jeff Niemann (9-5) won for the fifth time in six starts. He came in 0-2 with an 8.36 ERA in his last three matchups with Toronto, failing to work more than five innings in any of them.

Niemann reversed that trend, allowing three runs and five hits in 6 1-3 innings. He walked two and struck out six.

The right-hander improved to 8-1 with a 2.57 ERA in 12 starts since returning from the disabled list on June 20 after missing 39 games with a strained lower back.

"Not great but good," Maddon said of Niemann. "He got through it. He started out slowly but I thought he settled in pretty well. Then eventually, at the end there, you could see he got tired."

J.P. Howell replaced Niemann after J.P. Arencibia's RBI grounder in the seventh, ending Tampa Bay's streak of 11 consecutive games in which its starter worked at least seven innings.

Rays left-hander Jake McGee gave up a leadoff homer to Eric Thames in the eighth, the ninth of the season for the rookie outfielder. McGee got two outs before Juan Cruz came on and surrendered a solo homer to Edwin Encarnacion, his 14th. Kelly Johnson followed with a walk but Brett Lawrie fouled out.

Joel Peralta finished for his second save in four chances.

NATO attacks pro-Gadhafi forces near Sirte (AP)

TRIPOLI ? British warplanes struck a large bunker Friday in Moammar Gadhafi's hometown of Sirte, his largest remaining stronghold, as NATO turned its attention to loyalist forces battling advancing Libyan rebels in the area.

The airstrikes came a day after fierce clashes erupted in the Libyan capital, which remained tense as rebels hunted for the elusive leader and his allies. Pro-Gadhafi forces were shelling the airport and sporadic shooting was reported elsewhere, but the streets of Tripoli were relatively calm on Friday.

The military alliance said NATO warplanes targeted 29 vehicles mounted with weapons near the city, which is 250 miles (400 kilometers) east of the Libyan capital of Tripoli. Rebels are trying to occupy Sirte but expect fierce resistance from tribesman and townspeople loyal to Gadhafi.

The rebel leadership, apparently trying to avoid the bloodshed that occurred in the battle for Tripoli, has been trying to secure the peaceful surrender of Sirte, but the two main tribes have rejected negotiation efforts.

Gadhafi denied his people basic rights, cracked down harshly on any hint of dissent and squandered the country's vast oil and gas wealth on nations and tribes across sub-Saharan Africa.

But tribal loyalties are strong in the desert nation of 6 million people. Gadhafi also seeded supporters in key posts and built up militias and armed "revolutionary committees" to be the final line of support for him and his powerful sons if the regular military forces defected.

Gadhafi has tried to rally his followers from hiding, calling on them in an audio appeal as recently as Thursday to fight and kill the rebels.

The two main tribes in Sirte, the Gadhadhfa and the Urfali, remain loyal to the Libyan leader, although many others have disavowed him since the uprising began in mid-February, inspired by a wave of revolutions in Egypt, Tunisia and other Arab countries.

Mohammed al-Rajali, a spokesman for opposition fighters fighting Gadhafi loyalists in the east, said the rebels were trying to reach out to smaller tribes in Sirte but no progress had been made.

"We cannot reach the tribes with which we can negotiate," he told The Associated Press.

But the latest NATO airstrikes on loyalist vehicles defending Sirte appeared aimed at paving the way for the rebel advance if a negotiated settlement proves impossible.

In London, British Defense Secretary Liam Fox said some elements of the Gadhafi regime were in Sirte "where they are still continuing to wage war on the people of Libya." He said NATO would continue to strike at the Gadhafi forces' military capability.

"The regime needs to recognize that the game is up," Fox said.

Maj. Gen. Nick Pope, a British military spokesman, said royal Air Force jets also hit a large headquarters bunker in Sirte with a salvo of air-to-surface missiles.

NATO also bombed surface-to-air missile facilities near Tripoli, a statement said. Officials say Gadhafi's forces are trying to reconstitute their anti-aircraft weapons to pose a threat to humanitarian and civilian flights into Tripoli airport.

The airport was under rebel control but faced regular shelling from pro-Gadhafi forces to the east. At least three planes were burned in heavy shelling overnight, although the airport otherwise appeared largely intact, with a dozen other passenger planes on the tarmac.

"NATO is bombing those guys but they are still shelling from the east of the airport. They have totally destroyed three airplanes but hit others," Nasser Amer, a civil aviation official told the AP. Amer, a former pilot from Benghazi, traveled to Tripoli on Thursday to try to get the airport running again.

The rebels, meanwhile, were searching for the remnants of pro-Gadhafi forces in buildings in the Abu Salim neighborhood, which saw some of the heaviest fighting on Thursday.

Seven detained men and one woman were sitting in a pickup truck in a rural area between Abu Salim and the airport.

Rebel field commander Sathi Shneibi said there was suspicion that Gadhafi forces were trying to blend in with the civilian population.

"Things are still not stable and we are arresting anybody we find suspicious and taking them to the military council," he said.

Meanwhile, dozens of decomposing bodies were piled up in an abandoned hospital in Tripoli, a grim testament to the chaos roiling the capital as Libyan rebels clash with pro-Gadhafi forces.

The four-story hospital was in the Abu Salim neighborhood, which has seen some of the heaviest fighting this week, although the facility was empty and it could not be determined when the men had been killed. The floors were covered with shattered glass and bloodstains, and medical equipment was strewn about.

One hospital room had 21 bodies lying on gurneys, while 20 others were in the hospital's courtyard next to the parking lot ? all of them darker skinned than most Libyans, covered with blankets. Gadhafi had recruited fighters from sub-Saharan Africa.

With Gadhafi still on the run and vowing to fight to the death, the rebels have struggled to take complete control of the Libya capital after sweeping into the city on Sunday. The fight in Abu Salim has been particularly bloody.

Bursts of gunfire were heard coming from an area near the neighborhood before daybreak Friday. Smoke rose from the area but a rebel at the scene early Friday said the fighting in Abu Salim had ended by nightfall Thursday.

Men believed to be Gadhafi supporters or fighters were left moaning and calling for water at a clinic attached to a fire station in Abu Salim. Curious men from the neighborhood climbed stairs to look at the men, but none offered help.

One of the wounded said he was from Niger and denied any links to Gadhafi. Asked why he was in Libya, he said, "I really don't know." He did not give his name.

Gadhafi had recruited fighters from sub-Saharan Africa, and many others are in Libya as migrant workers. In the turmoil since the rebellion broke out, migrant workers from southern Africa have been harassed.

Associated Press reporters flagged down a cab to take some of the wounded from the clinic to a hospital. The driver at first agreed, but men from the neighborhood intervened, saying the men would have to be interrogated before they could be moved.

The opposition's National Transitional Council, meanwhile, moved forward with efforts to establish political control, announcing it is moving from the country's second-largest city of Benghazi in the east to the Tripoli.

The NTC's finance minister, Ali Tarhouni, said Gadhafi's capture is not a prerequisite for setting up a new administration in the capital.

"We can start rebuilding our country," Tarhouni said late Thursday. "He (Gadhafi) is the one who is basically in the sewer, moving from one sewer to another."

(AP) ? Mike Flanagan, a former Cy Young winner and part of the Baltimore Orioles' 1983 World Series championship team, has died. He was 59.

Authorities found a body outside Flanagan's home in Monkton, Md., on Wednesday afternoon. Hours later, the Orioles confirmed that Flanagan ? who served the team as a pitcher, front office executive and television broadcaster ? was dead.

"I am so sorry to hear about Mike's passing. He was a good friend and teammate," said Hall of Fame third baseman Cal Ripken Jr., a former teammate of Flanagan's. "... Mike was an Oriole through and through and he will be sorely missed by family, friends and fans. This is a sad day."

Flanagan was a crafty left-hander who went 167-143 with a 3.90 ERA over 18 seasons with Baltimore and Toronto. He didn't possess an overpowering fastball, but won a fair share of games by depending on a slow curve, a sinker and a changeup.

An All-Star in 1978, Flanagan received the Cy Young Award with the Orioles in 1979 after going 23-9 with a 3.08 ERA and five shutouts. The Orioles lost the World Series that year in seven games to Pittsburgh.

"He's one of our family. A great friend, competitor, whit, funny, hysterical, talented," former teammate and Hall of Fame pitcher Jim Palmer said after doing the Orioles' telecast Wednesday night in Minneapolis. "He was a breath of fresh air with his humor, his insight all those things. He was just a terrific guy."

Flanagan played for Baltimore's 1983 championship team, finishing 12-4 despite missing nearly three months with ligament damage in his left knee.

He was 141-116 with Baltimore and is a member of the team's Hall of Fame. Flanagan was also the final Oriole to pitch at Memorial Stadium, Baltimore's home from 1954-1991.

"Since the day I was given the number 46 I've had thousands of people tell me that that was the number of their favorite pitcher for the Orioles when they were growing up," Orioles pitcher Jeremy Guthrie said. "From Day One I think I've been reminded of the legacy and the work that Mike did not only as a player, but as a member of the community in Baltimore."

Flanagan's career with Toronto was not as profound. Traded from Baltimore to the Blue Jays on August 31, 1987, for pitchers Oswaldo Peraza and Jose Mesa, he went 3-2 with Toronto that season, then 13-13 and 8-10.

He signed as a free agent with Baltimore in 1991 and pitched out of the bullpen during his final two seasons.

After his playing career, Flanagan worked as the Orioles' vice president for baseball operations and executive VP. He teamed with Jim Duquette in the front office from 2005-07 in an effort to make Baltimore a winner.

"We spent hour after hour, day after day, trying to improve the Orioles," Duquette said late Wednesday night. "What stood out to me was his love for the Orioles and Baltimore. He was just so passionate about trying to get the Orioles back to where they were."

Duquette said he was "devastated and heartbroken" to learn of Flanagan's death.

"I just talked to him yesterday," Duquette said. "He was looking forward to broadcasting the Yankees series coming up."

In recent years, including this season, Flanagan did color commentary for the team's TV network, combining his wry sense of humor with a knowledge of the game that came from decades of experience.

"It is with deep sadness that I learned of the death of my friend Mike Flanagan earlier this evening," Orioles owner Peter Angelos said in a statement. "In over a quarter century with the organization, Flanny became an integral part of the Orioles family, for his accomplishments both on and off the field. His loss will be felt deeply and profoundly by all of us with the ballclub and by Orioles fans everywhere who admired him."

Flanagan grew up in Manchester, N.H., and pitched for the University of Massachusetts before being drafted by the Orioles in the seventh round of the 1973 draft. He made his major league debut in 1975. From 1977 through 1983, he made more starts (223) than any pitcher in the American League and was third in wins (109) during that span.

How the Rich Stayed Rich with Republican Bailouts (ContributorNetwork)

COMMENTARY | A disturbing report was filed by Bloomberg today. It details how some of the biggest banks in the United States were given $1.2 trillion to stay afloat during the economic crisis because of the bad home loans they offered to citizens who couldn't afford them.

The 10 largest banks in the United States had more than $100 billion in profits in 2006. Two years later, those same entities were asking for $669 billion in loans from Uncle Sam so they wouldn't collapse. After those amounts weren't enough, banks asked for and got hundreds of billions more.

The numbers alone are staggering. Yet somehow, Republicans believe taxing the wealthiest Americans, of which bankers are a part, is not prudent to solving our debt crisis. Keep in mind that some of the richest Americans were able to keep their wealth after the bailouts. In late 2010, tax cuts for the rich were maintained because the GOP sent a letter to Senate Majority Leader Harry Reid claiming they would block all legislation until those tax cuts were resolved. When President Barack Obama signed the tax cuts into law, it was only because the Republicans compromised and also passed unemployment benefits for the poor at the same time.

The U.S. stands at a crossroads. The message from Republicans was clear in December and the bailout debacle exacerbates what ordinary Americans already knew. Americans are used to government handouts and they don't want that to change. Individuals making over $250,000 don't want to pay more taxes. The poor don't want their unemployment benefits to expire because they get more from those payouts than they do with a minimum wage job.

The rich aren't creating jobs with the extra money they've been given. Unemployment is still over 9 percent as of July, three years after the financial crisis began. Yet Speaker of the House John Boehner claims raising taxes on these rich "job creators" would only make things worse.

I don't understand how banks taking taxpayers' money without remorse can make things worse. Democrats are trying to hold the richest Americans accountable for their actions by raising their taxes. The Republicans are defending them, the very people who caused this economic upheaval in the first place.

Those who lost their jobs either refuse to be hired or can't get hired because there is a stigma about giving someone a job who hasn't had one. Having more unemployed people just continues the vicious cycle of bad unemployment news and faltering stock prices.

The solution is easy. Every American needs to get back to work to make this country great. There are no more blue states or red states. Everyone has to be a viable contributor to the economic activity of the United States.

The fund known as Enhancing Pro-poor Innovation in Natural Resources and Agriculture Value-chain (EPINAV) will dish out up to 60m/- for the best proposal per year, which will lead to bring in new innovations in the field.

SUA?s Intellectual Property Specialist, Prof Amani Kweka said the fund targets research proposals that directly contribute to realisation of the programme outputs and purpose.

?To qualify for funding under EPINAV, a researcher must not only enhance frontiers of knowledge but be applied and useful to end users who are mainly smallholder farmers and other value chain actors,? he said.

The Professor in agricultural and forest engineering said the fund span is four years and might be renewed depending on the result.

He said SUA would have patent rights on the innovations, adding that the aim is to help farmers to increase their produce. He added that the research must address a specific theme or priority commodity for a particular district, region or zone.

Agriculture is the main source of livelihood for more than 83 per cent of the poor with women accounting for more than 70 per cent of agricultural production especially food crops.

The sector is almost entirely driven by smallholder farmers who depend on hand hoe, rain-fed agriculture and animal husbandry practices.

It is characterized by limited access to and participation in input and output markets, extension services; access to knowledge, information and financial services.

SUA has over the years developed and tested a good number of productivity enhancing technologies and best practices in various pilot villages in the country.
